2. GENERAL PROVISIONS

These General Conditions of Sale govern the terms and conditions of sale of the items offered on the site https://www.chimeric.fr to its Customers.
Any order appearing on the website https://www.chimeric.fr implies acceptance of these General Conditions. Any order confirmation entails your full and complete acceptance of these General Terms and Conditions of Sale, without exception or reservation.

All the data provided and the recorded confirmation will constitute proof of the transaction.

You declare to have full knowledge of it.

The order confirmation will constitute signature and acceptance of the operations carried out.

A summary of the information of your order and of these General Conditions will be sent to you in PDF format via the e-mail address confirming your order.

Chimeric reserves the right to modify the General Conditions of Sale at any time. Those that will be enforceable against the Customer will be those existing at the time of validation of the order.

3. PRODUCTS
In accordance with the provisions of Article L.221-5 of the Consumer Code, Chimeric presents on its Site, information on the Products (descriptions, prices), as well as all the necessary information relating to any order, so that the Customer can read it before ordering, in addition to the legal information appearing in the General Conditions of Sale.

4. PRICE

The prices of our products are indicated in euros including all taxes on the day of the order, unless otherwise indicated and excluding shipping costs.

In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of the company Chimeric. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. We advise you to inquire about these aspects with your local authorities.

All orders, whatever their origin, are payable in euros.

The Chimeric company reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price in force at the time of the validation of the order and subject to availability.

The products remain the property of the Chimeric company until full payment of the price.

Please note: as soon as you take physical possession of the products ordered, the risk of loss or damage to the products is transferred to you.
Payment is made:
- By credit card thanks to the secure system: the validation of the order by credit card is worth mandate to pay the price including tax of the order including the shipping costs.
When the amount of the Product order is greater than sixty-nine euros, shipping costs are free.

5. ORDER

The contractual information is presented in French and will be confirmed at the latest when your order is validated.

The Chimeric company reserves the right not to register a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.

6. AVAILABILITY
Our products are offered as long as they are visible on the site https://www.chimeric.fr and within the limits of available stocks. For non-stocked products, our offers are valid subject to availability from our suppliers.
In case of unavailability of product after placing your order, we will notify you by email. Your order will be automatically canceled and no bank debit will be made.

7. DELIVERY

The products are delivered to the delivery address indicated during the ordering process, within the time indicated on the order validation page.

In case of late shipment, an email will be sent to you to inform you of any consequences on the delivery time indicated to you.

In accordance with the legal provisions, in the event of late delivery, you benefit from the possibility of canceling the order under the conditions and methods defined in article L 138-2 of the Consumer Code. If in the meantime you receive the product, we will reimburse it and the shipping costs under the conditions of article L 138-3 of the Consumer Code.

In the event of deliveries by a carrier, the company Chimeric cannot be held responsible for late delivery due exclusively to the unavailability of the customer after several appointment proposals.


8. RECEIPT OF PRODUCTS
At the time of receipt of the products, the Customer must check, in the presence of the carrier, the condition of the Product delivered as well as its conformity with the order. If the Products have been damaged, the Customer must imperatively refuse the package and note a reservation on the delivery slip. This verification is deemed to have been carried out as soon as the Customer, or a person authorized by him, has signed the delivery slip.
The Customer must then confirm his reservations to the carrier by registered letter no later than three working days following that of receipt of the Products and send a copy of this letter by post to Chimeric.
In the event of an apparent defect in the Product or non-compliance with the order, the Customer must return the Product to Chimeric, indicating its reservations within 24 hours of delivery. Any complaint made outside this period cannot be accepted. The Product must be returned to Chimeric in the condition in which it was received at the following address: Chimeric, 179 rue Pierre Curie, 77550 Moissy Cramayel
If the apparent defect or non-compliance is recognized by Chimeric, the latter will deliver a new Product to the Customer. In case of unavailability of the Product, this one will refund the order as well as the shipping costs initially paid by the Customer.

9. LEGAL GUARANTEES
All Chimeric brand products benefit from the legal guarantee of conformity and the guarantee against hidden defects, provided for by articles 1641 and following of the Civil Code. In the event of non-compliance of a product sold, it may be returned, exchanged or refunded.

All complaints, requests for exchange or refund must be made by mail within 30 days of delivery.

The products must be returned to us in the state in which you received them with all the elements (accessories, packaging, instructions, etc.). The shipping costs will be reimbursed to you on the basis of the price invoiced and the return costs will be reimbursed to you on presentation of the supporting documents.

The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.


10. RIGHT OF WITHDRAWAL
In accordance with the provisions of articles L.221-18 and following of the Consumer Code, the Customer may cancel his order. To do this, he has a right of withdrawal. He may exercise it within fourteen (14) days of receipt of the Product by him or by a third party designated by him, other than the carrier.
Before the expiry of this period of fourteen (14) days, the Customer must inform Chimeric of its decision to withdraw by sending an email via the site's contact form. The Customer must clearly express this decision and communicate the information necessary to identify the order.
The Customer must return the Product(s), at his own expense, to Chimeric 179 rue Pierre Curie 77550 Moissy Cramayel, in its original packaging and no later than fourteen (14) days following the communication of his decision to withdraw. The Product(s) must be attached to the return form below.
Chimeric will refund the amount of the order as well as the delivery costs initially paid by the Customer, at the latest within fourteen (14) days from the date on which Chimeric collected the Product(s) or from the date on which the Customer provided proof of shipment of the Product.

11. INTELLECTUAL PROPERTY

All elements of the https://www.chimeric.fr site are and remain the exclusive intellectual property of the Chimeric company. No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site whether software, visual or sound. Any single or hypertext link is strictly prohibited without the express written consent of the Chimeric company.


12. IT AND FREEDOMS
Chimeric reserves the right to collect personal information and personal data concerning the Customer. They are necessary for the management of orders placed by the Customer, as well as for the improvement of the services and information that we send to you.

They may also be transmitted to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing and payment.

13. MISCELLANEOUS PROVISIONS
The fact for one of the parties not to take advantage of a breach by the other party of one of the obligations referred to in the General Conditions of Sale cannot be interpreted for the future as a waiver of the obligation in question.
Furthermore, in the event that one of the provisions of the General Conditions of Sale is or becomes invalid, impossible to execute or deemed null or void, the other provisions will continue to apply between the parties and produce their full and complete effect.
Vis-à-vis the provision invalidated or deemed void, the parties will endeavor to substitute a valid provision whose meaning will be as close as possible to that invalidated or deemed void.

14. APPLICABLE LAW AND JURISDICTION
The language of this contract is French. These conditions of sale are subject to French law. In the event of a dispute, the French courts will have sole jurisdiction.
